Before you proceed with our services, please carefully review the following Terms & Conditions that govern the relationship between you (hereinafter referred to as "Client") and Black Diamond Photography (hereinafter referred to as "Photographer" or "we" or "us"). By engaging our services, you acknowledge that you have read, understood, and agreed to abide by these Terms & Conditions:
Booking and Payment:
To secure our services for your wedding date, a non-refundable retainer fee of €350 is required upon the contract. This fee will be deducted from the total package price. 1.2. The remaining balance of the total package price must be paid on the wedding date, or as otherwise agreed upon.
Cancellation and Rescheduling:
In the event that the Client cancels the wedding photography services, the retainer fee is non-refundable. 2.2. If the Client wishes to reschedule the wedding date, the Photographer will do their best to accommodate the new date, subject to availability. Any payments made will be applied to the new date if possible.
Image Delivery:
The Photographer will provide the Client with a curated selection of high-resolution digital images from the event, which will be delivered through an online gallery or digital download, as specified in the chosen package. 3.2. The delivery time for the images will be within 6 to 10 weeks after the wedding date, unless otherwise agreed upon.
Copyright and Usage:
The Photographer retains full copyright and ownership of all images captured during the event. 4.2. The Client is granted personal, non-commercial use of the images, including sharing on social media and personal printing. However, the Client may not sell, publish, or otherwise commercially exploit the images without written permission from the Photographer.
Model Release:
The Client grants the Photographer the irrevocable and unrestricted right to use and publish images from the event for promotional and advertising purposes. 5.2. If the Client does not wish their images to be used for promotional purposes, they must inform the Photographer in writing before or at the time of the event.
Cooperation and Attendance:
The Client is responsible for providing a schedule of the event and designating an individual to coordinate photography on the day. 6.2. The Photographer will not be held responsible for the lack of coverage resulting from the absence of key individuals or schedule deviations.
Artistic Style and Editing:
The Client acknowledges familiarity with the Photographer's portfolio and is satisfied with their artistic style. 7.2. Editing style and color grading are left to the discretion of the Photographer, and requests for extensive editing or post-processing beyond the Photographer's usual style may incur additional charges.
Limitation of Liability:
. In the unlikely event of severe medical, natural, or other emergencies, the Photographer will make every effort to secure a replacement photographer. If a suitable replacement is not found, liability is limited to the return of all payments received. 8.2. The Photographer will not be held responsible for compromised coverage due to obstructions, interferences, or restrictions placed by event officials or venue staff.
Indemnification:
The Client agrees to indemnify and hold harmless the Photographer from any liabilities, damages, claims, or expenses arising from the Client's use of the images or any services provided by the Photographer.
Governing Law and Jurisdiction:
These Terms & Conditions shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising out of these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts in Ireland
